Powers of Attorney

1.      Lasting powers of attorney

Nicholson Portnell is able to offer advice to individuals on Lasting Powers of Attorney (LPAs) to cover both their Property and Financial Affairs and their Health and Welfare. We are happy to guide our clients through their decisions concerning

  • Who they may select as their attorneys
  • Whether they need replacement attorneys
  • Whether the attorneys are to act individually or collectively
  • What restrictions or guidance they may wish to give
  • Who may act as their certificate provider

We also deal with the subsequent court application to register the LPA with the Office of the Public Guardian, which is required to activate the document.

We are also able to offer advice on the actions an Attorney may take on behalf of the donor of the power

2.   Enduring Powers of Attorney

Although it is no longer possible to make an Enduring Power of Attorney (EPA), those set up prior to 1st October 2007 will continue to be valid.

3.   Deputyship

Where an individual loses mental capacity without having made a power of attorney, Nicholson Portnell is able to assist in dealing with the application to the Court of Protection for a Deputy to be appointed to assist with their affairs.
