You Can Still Choose the Beneficiaries of Your Will
Although there has been a lot of publicity surrounding the case of Mrs Ilott, who was awarded a share of her late mother’s estate, despite a Will saying otherwise, the basic principle of English law is still that you can make a Will leaving your estate to who you wish.
There has always been a class of people who can make a claim for reasonable financial provision against a person’s estate, and this has not changed. What the recent judgement makes clear is that, if you are going to exclude some-one who you might have been expected to support, you will need evidence to support that decision.
